Company structuring, trusts & foundations

A company, trust or foundation should reflect its purpose, ownership and governance needs. Ruchi Bindra advises on structuring, including offshore arrangements, with attention to control, disclosure, substance and cross-border operation. Tax and jurisdiction-specific advice are coordinated with qualified advisers; a structure is not a substitute for applicable reporting or regulatory duties.

Before we begin

What should you know before engaging counsel?

Is an offshore structure automatically suitable?

No. Its suitability depends on the purpose, jurisdictions, substance, costs and applicable obligations. A structure must be transparent and lawful in the places that matter to it.

Are trusts and foundations interchangeable?

No. They have different legal characteristics and are available on different terms across jurisdictions. Selection requires a fact-specific review.

Does structuring include tax advice?

Tax consequences must be reviewed with appropriately qualified tax advisers. Corporate documentation should reflect that advice rather than assume a tax result.
